These Terms and Conditions (or “T&C”) govern your use of NearbyBuddys, except where we expressly state that separate T&C will apply and provide information about the NearbyBuddys Service (“Service”), as described below. When you create a NearbyBuddys account or use NearbyBuddys, you agree to the T&C.

This T&C constitute an agreement between you and NearbyBuddys

NearbyBuddys Service

We agree to provide the NearbyBuddys service to you. This service includes all of NearbyBuddys’ products, features, applications, services, technologies and software that we provide to promote NearbyBuddys’ mission: to connect you to people nearby to your home or workplace.

This service is provided to you free of charge. Instead, businesses and organisations pay us to show you ads for their products and services. By using our Products, you agree that we can show you ads that we think will be relevant to you and your interests. We use your personal data to help determine which ads to show you.

The service includes these aspects:

• Providing personalised opportunities to create, connect, interact, discover and share There are varied types of people. We want to provide a platform to people, within the same location, to communicate and to share information about their work, interests, etc. To help you not only to grow personally, but professionally as well. That’s why we have built systems that try to understand what matters to you and others, and use that information to help you create, find, connect with, and share experiences that you want. It is part of highlighting content, features, offers and accounts that might interest you and offering you ways to experience NearbyBuddys based on the actions you and others take on and off NearbyBuddys.
• Promoting a positive and safe environment
  We develop and use tools and offer resources to our community members to help them make their experiences positive and engaging, including when we think they may need help. We also have teams and systems in place that combat harmful and fraudulent activities, in addition to abuses and violations of our rules and policies. We use all the information we have about us, including your information, to keep our platform, secure. We may also share information about abuse or harmful content with third-party companies or law enforcement organisations.
• Ensuring access to our services
  For our global service to operate, it is necessary that we store and transfer data on our systems around the world, including systems outside your country of residence. Providing our service requires the use of this global infrastructure. This infrastructure may be owned or operated by Countrywide Network Pvt. Ltd. Or their affiliates.

Data Policy

In order to provide our service, we need to collect and use your information such as name, mobile number, profile picture, location, device type, etc.

You can choose to provide information in your profile fields or life events about your religious views, political views, who you are “interested in” or your health. This and other information (such as racial or ethnic origin, philosophical beliefs, etc) could be subject special protections under the laws of your country.

We work with third-party partners who help us improve our products and services provided to people.

We store data until it is no longer necessary to provide our services or products or until your account is deleted – whichever occurs first. This depends on each incident, distinctly.

Information we receive about you can be accessed and preserved for an extended period when it is the subject of a legal request or obligation, governmental investigation or investigations of possible violations of our terms or policies, or otherwise to prevent harm.

Conditions for use

We want to make our service as free and inclusive as possible, but we also want to keep it safe, secure and within the legal barriers. That is why, we require that you accept certain restrictions in order to be part of the NearbyBuddys community.

• You must be at least 14 years old or the minimum age required by law in your country to use NearbyBuddys.
• Profile picture is mandatory for approval to open an account
• If your name is included on an applicable list of disapproved parties, you should not be restricted under applicable laws from receiving any aspect of our Service.
• Your account must not have been previously terminated by us in violation of the law or any of our policies.
• There is no tolerance for objectionable content or abusive users. Your account will be permanently deleted without any notice.
• NearbyBuddys App uses Youtube API services. All videos of YouTube whenever applicable are subject to YouTube Terms Of Services and Google Privacy Policy. By Downloading NearbyBuddys App, users are agreeing to bound by YouTube Terms Of Services

To provide a safe environment to users and free service to a range of people, it is required that we all do our part.

• You cannot pretend to be someone else or give false information
  You are not required to reveal your identity on NearbyBuddys, but you must provide us with accurate and up-to-date information, which may include personal data. Also, you may not pretend to be someone or something that you are not and may not create an account for another person unless they have expressly given you permission to do so.
• You may not do any illegal, deceptive or fraudulent act or for any illegal or unauthorised purpose.
• You may not do anything intended to interfere with or cause damage to the scheduled operation of the Service
  This includes abusing any reporting dispute or appeals channel, such as making fraudulent or unproven reports or appeals
• You may not sell, license or purchase any data obtained from us or our Service
  This includes attempts to buy, sell or transfer any part of your account (including your username); solicit, collect or use another user’s login credentials or badges; or requesting or collecting an NearbyBuddys’s username, password or misusing an access token.
• You may not post someone else’s personal or confidential information or do anything that may infringe someone else’s rights, including intellectual property rights (such as copyright infringement, trademark infringement, counterfeiting or counterfeit goods) without permission)
  You may use someone else’s work subject to the limitations or exceptions of copyright and under relevant rights under applicable law. You represent that the Content you post or share is yours or that you have acquired all necessary rights to it.
• You may not modify, translate, create derivative works of our products or their components, or create a product similar to those without knowledge of their composition.
• You may not use a domain name or URL in your NearbyBuddys’s username without our prior written consent

The permissions you give us, as part of our agreement, gives us permission we need to provide the Service

• We do not claim ownership of your content but you give us a licence to use it.
  Though we do not claim ownership on your content, we require certain legal permissions from you (licence) so to provide the Service to you. When you share, post or upload content that is protected under intellectual property rights (such as photos or videos) on or in relation to our Service, you hereby give us, your Content’s non-exclusive, royalty-free, transferable, sub-licence to host, use, distribute, modify, play, copy, publicly represent or display, translate or create any original work based on qualified or worldwide licences. This licence will terminate once your content is removed from our platform. You can delete the entire content at once by deleting the content or deleting your account.
• Permission to use information related to your username, profile photo and account, your workplace, location, etc
  You give us permission to follow or engage with your username, profile photo and information about your actions without any compensation to you.
• You agree that we may download and install service-related updates to your device

Additional Rights we hold

• If you select a username or similar identifier for your account, then we can change it as we think is necessary. Such cases can be but not limited to, to avoid infringement to someone’s intellectual property rights or impersonates someone.
• If you use material covered by our intellectual property rights that we hold and that we make available on our Service, we reserve all rights relating to such content.
• You must obtain permission from us, in writing or under an open-source licence, to modify, create derivative works of, decompile or otherwise attempt to obtain our source code from us.

Remove any content from your account and close or terminate your account

If we believe that the content or information you share on the NearbyBuddys’s platform violates our T&C or our Privacy Policy, we may remove them. If you repeatedly violate our T&C, or our policy, or infringe on other people’s intellectual property rights, or we are permitted or required to do so by law, we will refuse to provide the whole or part of the Service to you and also may disable your access (including terminate your account).

If you delete your account or we terminate your account, our T&C will cease to be an agreement between you and us.

You can delete content individually or all at once by deleting your account. To delete your account, you will need to connect with our customer support.

When you delete content, it is no longer visible to other users, however, it may continue to exist elsewhere on our systems where either immediate deletion is not possible due to technical limitations, or, your content has been used by others in accordance with this licence and they have not deleted it. Also, if the immediate deletion would restrict our ability to investigate or identify illegal activity, or breached of our T&C; or comply with a legal obligation, such as preservation of evidence; or comply with a request of a judicial or administrative authority, law enforcement or government agency; the content would be retained for longer period of time, for the purposes.

Authorisation

We provide you with a non-exclusive, worldwide and perpetual licence to perform, display and use the platform.

Responsibility

We try to provide our Service to the best of our capability, but we cannot guarantee that it will always be secure or work properly. To the extent permitted by law, we also disclaim all warranties, whether express or implied, including implied warranties of fitness for a particular purpose, copyright and non-infringement.

We also do not control what other people do or say, and we do not control their (or your) actions or conduct (whether online or offline) or content (including illegal or objectionable content). We are not liable for services and features offered by other people or companies, even if you access through our Service.

Our responsibility or liability for any activity that occurs on the platform is limited to the extent permitted by law. If there is a problem with our service, we cannot say what all would be the possible effects it could have. You agree that we are not liable for any loss of profit, income, information or data or any consequential, special, indirect, illustrative, punitive or incidental damages caused by or relating to these T&C, even if we have the knowledge of the possibility of them. This includes the removal of your content, information or account by us.

Disputes

If you are identified as a consumer, any claim, case, action or dispute against us arising out of in connection with these T&C, or the Privacy Policy, will be governed by the laws of country namely India. The first attempt must be to resolve the dispute in an arbitration. If one is not satisfied with the conclusions of the arbitration, then the claim may be settled in the competent court of the state of Delhi in India which has jurisdiction to dispose of the claim.

Update of these T&C

We may make changes to this T&C, our service and Privacy Policy. Unless otherwise required by law, we will notify you before we make changes to these T&C and give you an opportunity to review them before they become effective. Thereafter, if you continue to use the platform, you will be bound by the updated T&C and Policy. If you do not wish to accept these T&C or any of the updated T&C, you may delete your account.
